Tire Blowout Accident Leads to One Death

WrongfulDeath4

A tire blowout accident turned fatal in Oklahoma. One passenger was killed after the driver’s side rear tire blew out on the highway. The passenger, 74-year-old Gonzalo Arrendondo was pronounced dead at the scene. The driver was flown to a nearby hospital in good condition. An investigation is still underway as to the cause of the accident.

Car Accidents Caused by a Tire Blowout

When a tire blows out at a slow speed, you hear it and notice a jolt. The car will begin thudding if you try to continue driving. If the tire blows out at a high speed, the jolt becomes remarkably dangerous. Most folks attempt to compensate by hitting the brakes or turning the wheel into the opposite direction that the car is pulling. But this often makes the problem worse. Often, other cars beyond the driver’s are involved in these crashes. Sometimes, it’s the driver’s own lack of maintenance on his car that caused the accident in the first place.

Causes of Tire Blowout Accidents When the Driver is At Fault

When the driver is at fault for the accident, it’s usually because the tire is either old or improperly maintenanced. Today, most vehicles have tire pressure monitoring systems that relay whether or not your tires are over- or under-inflated. Both can be dangerous and make your tire more prone to suffering a catastrophic blowout.

In other cases, the tread may be worn down to the extent that the tire is no longer safe. As happens to those with luxury cars that they only drive in the summer months, tires age and the rubber becomes more brittle. As that happens, the tire becomes more prone to a blowout even when the treads are still under warranty and there are only a few thousand miles on them.

Causes of Tire Blowout Accidents When the Tire Company is At Fault

Tire liability lawsuits are filed under the theory of product liability. Product liability lawsuits come in three varieties. There are design defect lawsuits, where the plaintiff alleges that a design flaw caused their injuries. There are manufacturing defect lawsuits that allege that something happened during manufacturing that made the tire unsafe to drive on. And there are failure to warn lawsuits that allege that some potential problem should have been explained to the customer to prevent an accident from occurring.

If the tire company is to blame for the accident, you can file a lawsuit against them as can any other driver who was injured in the accident in which your tire blew out. You can recover damages for lost wages, medical expenses, and pain and suffering. The attorneys at Halpern, Santos, & Pinkert can help you do that.
